HHS to Request Extension of EVV Cures Act Home Health Care Services Implementation to Jan. 1, 2024

Federal law requires states to implement Electronic Visit Verification(EVV) for Medicaid home health care services by Jan. 1, 2023 (PDF).
Texas Health and Human Services (HHS) will request a good faith effort (GFE) exemption from the Centers for Medicare and Medicaid Services (CMS) to extend this deadline by one year. CMS will begin accepting GFE requests in July 2022. HHS plans to submit a request at that time and expects to receive a response from CMS within 30 days.
HHS plans to implement EVV for Medicaid home health care services on Jan. 1, 2024. Those affected by the Cures Act Home Health Care Services implementation do not need to act now. They can review the current resources below. We will continue to share information as the implementation progresses, including how to get started with EVV.
Program providers, Financial Management Services Agencies (FMSAs) and Consumer Directed Services (CDS) employers, must continue to use EVV for Medicaid personal care services (PDF).
HHS will continue analyzing the programs, services and service delivery options required to use EVV by Jan. 1, 2023.
